and T&Cs
TERMS & CONDITIONS
Payment of the Deposit constitutes acceptance of the following Terms and Conditions.
1. Definitions.

“Booking” means the period for which you have paid to stay at the Hummingbird Centre of Awakening.

“The Hummingbird Centre of Awakening” means all of its fixtures, fittings, equipment and grounds.

“Our Team” means the owners and the team of the Hummingbird Centre of Awakening.
-
“Facilitator” means the persons who made the Booking and all assistants, in any capacity.
-
"Guests" means the persons who stay overnight at the Hummingbird Centre of Awakening during the Booking.
-
"Visitor" means a person a Guest or Facilitator permitted to visit the Hummingbird Centre for Awakening during the Booking.
-
"Event" means a booking that includes Visitors.

​2. Check-in / check-out
-
Check-in: 3 pm on the arrival date or by prior arrangement.
-
Check-out: Please let us know your needs when checking out. In the spirit of understanding the flowing nature of Sacred events, if we have no other booking on your departure date, we can offer a check-out of no later than 12 pm. If you need to check out later than 12pm extra charges will apply.

Please notify our Team of your expected arrival time and provide a mobile contact number
at least 7 days before arrival.

​​3. Payment

A minimum deposit of 50% must be received within 3 days after the Booking is taken by our Team.

Bookings are confirmed when the deposit is received.
-
Payment in full (50%) must be received no later than 60 days before the check-in date, unless by prior arrangement.
-
We accept payment by Website only. Cash payments may be considered by prior arrangement.
4. Cancellation or Date Variations
-
If you need to vary or cancel your Booking, please advise us in writing coordinator@thehum.one

In the event of cancellation:
-
Up to 60 days: For cancellations that are made up to 60 days before your arrival, you will receive a full refund of the deposit paid minus a $300 admin fee.
-
Within 60 days: For cancellations that are made inside the 60 days, you will receive aa full refund, minus a $300 admin fee, if there is someone to fill the vacancy or a 50% refund, minus a $300 admin fee, if the vacancy cannot be filled.

Within 30 days: For cancellations that are made within 30 days, you will only receive a refund, minus a $300 admin fee, if there is someone to fill the vacancy. If your vacancy cannot be filled, sorry no refund.

Change of date: With more than 60 days' notice prior to the arrival date, your booking may be changed without penalty subject to availability and must be within 12 months of the original arrival date. Only one date change is allowed per booking.

A change of date within 60 days of your booking date is considered a cancellation and our cancellation terms will apply. However, if we can fill in your vacancy, only a $100 admin fee will apply.

​5. Security Deposit:

A security deposit for the amount of AUD 600 is to be transferred at the time of booking.

Any damage loss, or expense incurred by the Hummingbird Centre for Awakening as a result of your booking will be deducted from the deposit and the balance returned. Examples include, but are not limited to any breakage, damage excess cleaning requirements or extra Guests beyond those declared. Should anything be lost, damaged or broken, we ask that you advise us immediately so we can work together to reach a positive outcome for everyone.

6. Unavailability
If the Property becomes unavailable for your occupancy due to unforeseen circumstances (e.g. fire, storm, flood, damage, etc) then our Team will inform you immediately and any monies paid will be refunded in full.
7. Events, Training, Retreats & Functions. Sound requirements.

Facilitators and Guests remain responsible for not disturbing neighbours, no undue noise, nor behaviour likely to cause property damage.
-
All noise must cease by 10:00 pm.
-
All music is to be lightly amplified (the limit set in Byron Bay and the hinterland is 94 dB.)
-
Breach of noise conditions will result in immediate termination and eviction without refund and extra charges for security, cleaning, garbage removal, wear and tear etc.

8. General
-
There is a daily charge of $25 for wood unless it is agreed in advance that the Facilitator will not be using wood during their booking.
-
Facilitators must provide a current copy of their public liability insurance in advance of the arrival date. We are not covered for damage or injury during classes.
-
We recommend taking out specific insurance for your Event to cover any unforeseen circumstances or force majeure.
-
We reserve the absolute right and without notice to you to exclude or remove from the event or premises any person whose behaviour is undesirable or offensive.

No use of or adding of nails, hooks, hanging of any item, or plugging in of equipment is
-
permitted without prior approval.
-
Management reserves all rights to refuse a booking and refund any payments.
9. Linen & laundry
-
We supply linen, pillows, sheets, towels, hand towels and bath mats.
-
Please do not take extra from the laundry unless agreed in advance.
-
You are welcome to use the laundry for longer stays of 6 days or more – please supply your own washing powder.
-
We ask that you do not move any furniture to avoid damage to the floor or furnishings.
-
Please wipe up spillages on the wooden floor immediately, to avoid staining the floor.

10. Your Responsibilities
-
The Hummingbird has been created for high calibre facilitators to have a space to share healing and awakening work with others.
-
You must comply with all applicable Property Rules and all instructions from Management and the caretakers of the Property concerning occupancy, property, health, safety and quiet enjoyment of the Property.
-
You are responsible for damage, breakages, theft and loss incurred at the Property and to any part of the Property during your stay.
-
You must notify us of any damages immediately. Additional fees may be incurred to replaces or repair damages sustained during your hire period.
-
Only the guests nominated and agreed in the Booking may stay in the Property overnight. If anyother guests stay extra charges may apply or the agreement may be terminated without a refund.

Disturbance to our neighbours, including excessive noise, is prohibited and will result in termination and eviction without refund and extra charges may be made for security and other expenses.

11. Departure

We ask that linen be left on the bed and towels be left in the laundry baskets on departure.
-
Before departure, all food must be removed from fridges, all rubbish put in the appropriate council rubbish bins provided, and crockery and cutlery washed and packed away. The Property must be left as clean and tidy as you found it at check-in.

Extra cleaning charges may be incurred for the cleaning of dirty dishes, washing machine, dishwasher, emptying the fridge, removal of excessive rubbish etc

Furniture and furnishings must be left in the position they were in when you arrived unless arranged at check-in.

The property should be vacated on time.

​12. Problems or Complaints
-
In the case of any problem or complaint, you must inform Management at the earliest opportunity, so Management has the chance to rectify the situation as quickly and efficiently as possible.

You must allow service access to the property.
-
Any complaint, that cannot be resolved locally, must be notified in writing to Management before departure from the Property.
-
Failure to follow this procedure may hinder the ability of Management to rectify the problem or complaint and reduce or extinguish any claim you may have.

We recommend all guests purchase travel insurance since Management is not responsible for any injuries, illness or accidents that may occur whilst staying at our property.

13. Discretion
-
The Hummingbird Centre for Awakening has the right to refuse a booking and refund any payments made at its discretion.

The Hummingbird Centre for Awakening accepts no responsibility or liability for any loss or damage to any property belonging to the client or the client’s guests, including hire equipment and all items that are on site.

We reserve the right in our absolute discretion to exclude or remove any undesirable
-
persons from an event or premises without liability.

Covid Rescheduling In addition to our standard Terms and Conditions, if any new government
restrictions affect your ability to travel, we will allow the booking to be rescheduled within 12
months. Please note this only applies to new travel restrictions and does not apply to any existing
